Welcome to The Rug Diary. "We", "us" and "our" refer to The Rug Diary, 11136 CA-1 # A, Malibu, CA 90265, United States. These Terms of Service ("Terms") apply to your use of this website and any purchase you make from us. By using the site or placing an order, you agree to these Terms and to our Privacy Policy.

1. Using our site

You must be at least the age of majority where you live to place an order. You agree to give accurate, current information when you order and to keep your account details secure. You may use the site for personal, lawful purposes only.

2. Our products

We do our best to describe and photograph each rug accurately. Because every rug is an individual piece, small variations in color, size (typically within a few inches) and pattern are normal and are not defects. Colors may look different depending on your screen. If you are unsure, ask us for extra photos or a video call before you buy.

3. Orders

Placing an order is an offer to buy. Your order is accepted when we confirm it by email. We may decline or cancel any order, for example if an item is no longer available or a price was shown in error; if we cancel after payment, we refund you in full. You may cancel for a full refund at any time before your order ships.

4. Prices and payment

Prices are shown in US dollars and may change without notice. The price you pay is the price shown when you place your order. Unless stated otherwise, prices do not include sales tax, which is added at checkout where required. Payments are processed securely through Shopify; we never see your full card details.

5. Shipping and delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers or events outside our control. Please inspect your rug when it arrives and keep the packaging until you have checked it.

6. Returns and refunds

All sales are final. Returns are accepted only for damaged, defective or wrong items, as set out in our Return & Refund Policy. In those cases we pay the return shipping.

7. Intellectual property

All content on this site, including text, photos, graphics and logos, belongs to The Rug Diary or its licensors. You may not copy, reproduce or reuse it without our written permission.

8. Third-party services and links

Our store is powered by Shopify. Purchases are made directly with The Rug Diary, and Shopify is not responsible for any part of the sale. Links to other websites are provided for convenience; we are not responsible for their content or practices.

9. Reviews and feedback

If you send us a review, photo, idea or other feedback, you allow us to use it to run and promote our store. Content you submit must be your own, truthful, and lawful. We may remove content at our discretion.

10. Prohibited uses

You may not use the site to break any law, infringe anyone's rights, send spam or malicious code, scrape or copy the site, or interfere with its security.

11. Disclaimer

Except as expressly stated in these Terms or our policies, the site and products are provided "as is" and "as available", to the fullest extent permitted by law. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.

12. Limitation of liability

To the fullest extent permitted by law, The Rug Diary is not liable for indirect, incidental, special or consequential damages arising from your use of the site or products, and our total liability for any claim is limited to the amount you paid for the product involved.

13. Indemnity

You agree to hold The Rug Diary harmless from claims arising from your breach of these Terms or your misuse of the site.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Los Angeles County, California, and you and we consent to their jurisdiction.

15. Changes

We may update these Terms from time to time. The version posted on this page applies to orders placed while it is posted. If any part of these Terms is found unenforceable, the rest remains in effect.
